Guardianship of a minor in AZ

Title 14 of Arizona law allows a person concerned about the welfare of a minor child to petition the court for an appointment as guardian of a child. In certain cases, the court may appoint someone other than a parent – usually a relative – as the child’s guardian.

The guardian of a minor takes over parental responsibility for care and decisions about that child’s housing, medical care, and education. As the petitioner, you’ll be required to serve a legal notice upon whoever has been responsible for the child’s welfare during the 60 days before the date of your petition. Legal notice must also be given to any living parent of that child and to any minor who is 14 years or older and can understand the process.

Will the parents contest your petition?

Most commonly, minor guardianship involves a situation where the child’s grandparents take over responsibility when the biological parents are unable to do so. If the child’s parents are involved and both seem likely to object to the request, then an attorney should be consulted.

On the other hand, if at least one parent will consent to allow guardianship, then the process is more straightforward.
